Purchases made by minors

Users agree that by using our site, they are over the age of 18. If you are under the age of majority and wish to make purchases from our store, a parent or duly appointed guardian must make that purchase for you. We assume no legal responsibility for misrepresentation of age.

Typographical errors

At Chocolat-Chocolat Inc. we do our best to provide you with the most up-to-date and reliable information available. In the event of an error, we reserve the right to cancel any order.

Litigation

It is mutually agreed and understood that any litigation or claim between the buyer and the seller (Chocolat Chocolat Inc.) of any nature whatsoever, will be heard by a court of law in the judicial district of Montreal.

Intellectual property

All content published and made available on this site is the property of Chocolat-Chocolat Inc. and its creators and collaborators. This includes, but is not limited to, images, texts, logos, documents, downloadable files and everything that contributes to the composition of this site.

The products linked to this document are the products that are displayed on our site at the time you access it. This includes all products listed as being out of stock. Any information, descriptions or images we provide about our products are presented as accurately as possible. However, we are not legally bound by such information, descriptions or images, because we cannot guarantee the accuracy of every product or service we provide. You agree to purchase these products at your own risk.

Payments

We accept the following payment methods on this site:

  • Credit Card

When you provide us with your payment details, you are confirming that you have authorized the use of and access to the payment instrument you have chosen to use. By providing us with your payment details, you are confirming that you authorize us to charge the amount due to that payment instrument. If we believe that your payment has violated any law or any of our terms of use, we reserve the right to cancel your transaction. All prices listed on the site are in CAD (Canadian Dollars) and always include Goods and Services Tax (TPS) on all taxable items in our online store. In Canada, the Goods and Services Tax (TPS) is applied on all items in our online store. In Quebec, the provincial sales tax (TVQ) is added on all the items of our store except on the books and unprocessed edible products. For international orders, customers must pay all mandatory taxes or fees.

In store we accept the following payment methods: CASH, DEBIT CARD, VISA, MASTERCARD, AMERICAN EXPRESS AND DISCOVER. All prices are in Canadian dollars.

Modifications

These terms and conditions may be amended from time to time to maintain compliance with the law and to reflect any changes IN the way we operate our site and the way we expect users to behave on our site. We recommend that our users check these terms and conditions from time to time to ensure that they are aware of any updates. If necessary, we will notify users by e-mail of changes to these terms and conditions or post a notice on our site. If at any time any of the provisions set forth herein are determined to be inconsistent with or invalid under applicable law, such provisions shall be deemed void and shall be removed from this document. All other provisions will not be affected by the remainder of this document and will still be considered valid.

Shipping and delivery

When you make a purchase on our site, you agree and acknowledge to provide both a valid email and shipping addresses for your order. We reserve the right to change, reject or cancel your order whenever necessary. If we cancel your order and have already processed the payment, we will make a refund equivalent to the amount you have paid. You agree that it is your responsibility to monitor your payment method. While we aim to provide you with an accurate estimate of shipping times and costs, these may vary due to unforeseen circumstances. (For example; weather condition, shipping compagnies strikes, seasonal traffic overload, custom clearance, etc…)

Customs and taxes

Chocolat-Chocolat Inc. covers the cost for customs and taxes if applicable. To expedite customs clearance, we must obtain your federal identification number or, if applicable, your social security number. Gestion Drolet molds made in Canada are eligible for A.L.E.N.A. tariffs with certificate of origin.

Returns

Our goal is your complete satisfaction. Upon receipt of your package, we ask you to examine it closely before opening it. If it is damaged, you must refuse the package.

If you are not satisfied with your order, you may return it at your expense. Please request a return authorization number by phone or email. Upon reception of the returned package, we will credit your account excluding shipping charges unless the error was made by Chocolat-Chocolat Inc. makes an error. Products must be returned in their original and complete condition. A 25% restocking fee will be applied at all times on all returns within 14 days of purchase following receipt of the order. You will be notified of your refund by email. Important: Orders returned with missing, broken, altered or used items will not be accepted, nor credited. All claims must be made within 14 days of receipt of merchandise. After the 14 day period following receipt of the merchandise, no claims are possible.

Refunds on purchases made by credit card will be credited to the same card.

Applicable laws

This document is subject to the applicable laws of Canada and its necessary rules and regulations.
